TERMS AND CONDITIONS OF WARRANTY

 
(In case of discrepancy between the English and Chinese version of these terms and conditions, the English version shall prevail.)
   
Guarantee/Warranty:
Shopforbettersleep.com (SFBS) and Lifestyle Medico Limited does not offer any guarantee on any products sold. The maximum liability of the SFBS and Lifestyle Medico Limited under any warranty shall be restricted to the replacement value of the Product.
   
Manufacturer Guarantee/Warranty:
Manufacturer product warranty period is shown on individual product description on the shopforbettersleep.com; if in doubt please contact cs@shopforbettersleep.com before making a purchase. In case of a claim under the Manufacturer guarantee for any product, the date of purchase must be proved by means of a purchase receipt or an invoice issued by www.shopforbettersleep.com and please contact cs@shopforbettersleep.com located in Hong Kong S.A.R.  In case of a claim under the guarantee, product(s) must be sent back to www.shopforbettersleep.com office in Hong Kong S.A.R., freight paid, for performance of guarantee/warranty. Please do not send us the product carriage due, rather please contact your specialist retailer cs@shopforbettersleep.com in advance. Please do not send the device until we have instructed you to do so. Should you have been requested by cs@shopforbettersleep.com to send the device, please state the defect and attach a copy of the shopforbettersleep.com purchase receipt for the said product.  We seek your understanding that we will not be able to entertain any claim on product(s) without a valid receipt that is issued by shopforbettersleep.com for the any item. 
 
TERMS AND CONDITIONS :
1. If you complete the product warranty registration online with shopforbettersleep.com with the product model number and serial number within 30 days from the date of purchase1 of the product, then the warranty set out in these terms and conditions will apply.
2. Warranty only applies to the product with original receipt or invoice from shopforbettersleep.com or Lifestyle Medico Ltd.  
3. Subject to Clause 1, your original invoice from shopforbettersleep.com entitles you to warranty services set out in Clause 6 for the period from the date of purchase set out in Clause 5 (the "Warranty Period"), provided that the original invoice (as the case may be) or receipt is stamped by shopforbettersleep.com (“SFBS”) and dated with the date of purchase. All Product Warranties will only be valid if the Product was purchased in Hong Kong SAR (“Hong Kong”).
4. The original invoice for the Product must be presented when making any claim under this warranty. All Product Warranties will only be valid if the Product was purchased from SFBS in Hong Kong SAR (“Hong Kong”). Warranty services may only be sought in Hong Kong SAR.
5.
Provisions for Specific Products
5.1)
All MEDISANA Products and packaging are manufactured for German/Europe market with a three (3) years or more warranty. This MEDISANA express warranty shall not apply to products sold by SFBS or by Lifestyle Medico Limited. The MEDISANA Manufacturer warranty for all MEDISANA Products sold by SFBS or by Lifestyle Medico Limited is one (1) year from the date of purchase. All MEDISANA Warranty will only be valid if the Product was purchased in Hong Kong SAR (“Hong Kong”). Warranty services may only be sought in Hong Kong SAR. In case of a claim under the warranty, the date of purchase must be proved by means of a purchase receipt or an invoice issued by SFBS.
5.1.1. During the warranty term, defects which arise due to defects in materials or the manufacturing process will be corrected free-of-charge. The guarantee service will be provided by means of restoration, i.e. repair or replacement of parts, depending on the choice of MEDISANA. Should a repair be impossible or uneconomic, MEDISANA will replace the device by means of an equivalent replacement product. Replaced parts and exchanged devices shall become the property of MEDISANA.
5.1.2. Any services under the warranty shall neither bring about an extension to the warranty period, nor shall they substantiate a new guarantee.
5.1.3. The online warranty extension program by MEDISANA does not apply to products sold by www.shopforbettersleep.com
5.1.4.
The following are excluded from the warranty:
All damage caused by improper handling, for example due to non-compliance with the usage instructions.
Damage caused by repairs or interferences on the part of the buyer or unauthorised third parties.
Damage to machine motors caused by not replacing dirty filters.
Damage which is caused during transportation between the manufacturer and the consumer, or during forwarding to the service centre or distributor.
Accessory parts which are subject to normal wear-and-tear.

Products which were not purchased directly from www.shopforbettersleep.com
5.1.5. Additional or other claims are not substantiated by this guarantee. Liability for indirect or direct consequential losses which are caused by the device shall also be excluded, should the damage to the device be recognised as a warranty claim.
5.1.6. The guarantee shall lapse should the type label or device number be removed or made unreadable
5.1.7. The guarantee shall also lapse if the defect is not notified immediately.
5.2) Sleep Shepherd LLC Product or Sleephat is manufactured for use in 50Hz frequency for AC power countries, please check http://sleephat.com/sizing/
The Sleep Shepherd LLC Manufacturer warranty for all Sleep Shepherd LLC Products sold by SFBS or by Lifestyle Medico Limited is ninety (90) days from the date of purchase. Warranty will only be valid if the Product was purchased in Hong Kong SAR or Singapore and from SFBS or Lifestyle Medico Limited. Warranty services may only be sought in Hong Kong SAR or Singapore. In case of a claim under the warranty, the date of purchase must be proved by means of a purchase receipt or an invoice issued by www.shopforbettersleep.com.
5.3) Metran’s Manufacturer warranty for Jusmine Auto-Adjusting CPAP sold by SFBS or by Lifestyle Medico Limited is twelve (12) months from the date of purchase. Metran Warranty will only be valid if the Product was purchased in Hong Kong SAR (“Hong Kong”). Warranty services may only be sought in Hong Kong SAR. In case of a claim under the warranty, the date of purchase must be proved by means of a purchase invoice or receipt issued by SFBS referencing the model and serial number of Jusmine Auto-Adjusting CPAP.
6.
During the Warranty Period and provided that the Product was used under normal conditions, you will be entitled to the repair service of the Product and replacement of parts (the “Repair Work”) free of charge arising from defects in the materials and workmanship of the Product (fair wear and tear excepted), save as the following circumstances in which the Manufacturer shall exercise its sole and absolute discretion to determine and the Manufacturer’s decision shall be final, whether to charge a service fee for the Repair Works or not to carry out the Repair Work:
6.1) Where valid Warranty Card and related invoice / receipt are not presented;
6.2) Where the date of sale, product model, product serial number, name of Lifestyle Medico Limited dealer, has not been recorded on Warranty Card or original invoice or receipt has been altered; or where the receipt or invoice does not bear the chop of the Lifestyle Medico Limited;
6.3) Where damage was caused by the use of parts / accessories not produced by the Manufacturer;
6.4) Where the Product was not used, repaired or maintained in accordance with the user manual (damage caused by using the Product not within the controlled environment including but not limited to expiry of specified rating, abnormal changes or inappropriate voltage, current, electromagnetic and public circuit etc.);
6.5) Where damage was caused by accidental damage (including but not limited to shock, impact, dropping, water damage or sand damage);
6.6) Where damage was caused by repair, transformation, decomposition, or cleaning carried out by a person or an agent not authorized by the Manufacturer or by the customer himself / herself;
6.7) Where the date of sale, product model, product serial number, name of SFBS, has not been recorded on Warranty Card or original invoice or has been altered; or Warranty Card or invoice does not bear the chop of SFBS;
6.8) Where the model or serial number of the Product recorded Warranty Card or SBFS invoice is different from that recorded on the Product;
6.9) Where damage was caused by a Product which is altered from the Product structure or specification as stated in the package and user manual;
6.10) Where non-Manufacturer consumables (filters, batteries, chargers etc.) were used on the Product (whether or not damage was caused by such use);
6.11) Where damage was caused by using pirated software;
6.12) Where damage was caused by virus infection during usage;
6.13) Where damage was caused by force majeure;
6.14) Where the damage is caused by your negligence and misuse of the Product or incurred during transportation of the Product not carried out by SFBS or Lifestyle Medico Limited or the Manufacturer;
6.15) Where the Product is not supplied by SBFS or by Lifestyle Medico Limited;
6.16) Where the productions of the Product, its accessories and spare parts have been discontinued.
6.17) All consumables, accessories and optional items such as, but not limited to filters, connection cables, battery, charger, memory card, external casing and battery cover. (SFBS and Lifestyle Medico Limited reserve the right to amend the list of consumables, accessories and optional items without prior notice);
6.18) Additional or other claims are not substantiated by this guarantee. Liability for indirect or direct consequential losses which are caused by the device shall also be excluded, should the damage to the device be recognised as a warranty claim.
6.19) The guarantee shall lapse should the type label or device number be removed or made unreadable.
6.20) The guarantee shall also lapse if the defect is not notified immediately.
6.21) Warranty shall be automatically cancelled if the Product or any part(s) thereof are modified, tampered with, altered, converted or repaired in anyway by anybody other than the staff or authorized service providers of the Manufacturer. The Manufacturer’s decision to cancel this warranty shall be final.
7.
Any services under the warranty shall neither bring about an extension to the warranty period, nor shall they substantiate a new guarantee. This warranty does not cover accessories of any Product or consumables sold on SFBS or by Lifestyle Medico Limited. This warranty does not cover the followings:
a) All consumables, packaging, accessories and optional items such as, but not limited to filters, connection cables, battery, charger, memory card, external casing and battery cover. (SFBS and Lifestyle Medico Limited reserve the right to amend the list of consumables, accessories and optional items without prior notice);
b) Software, firmware, driver compact disc, user manual and the related installation;
c) Notwithstanding anything herein contained, SFBS and Lifestyle Medico Limited shall not be liable to the user or any third party whatsoever for any damage, loss, liability or failure to provide maintenance services under this warranty in respect of any act, omission or negligence of any technician, employee or independent contractor of SFBS and Lifestyle Medico Limited relating to the performance or purported performance of any obligations under this warranty.
d) You shall bear the risk and be responsible for all damage, injury or loss (including consequential loss, loss of profit, injury or damage) arising directly or indirectly out of or in connection with the service, delivery, or use of the Product.
e) The maximum liability of the Manufacturer or SFBS and Lifestyle Medico Limited under this warranty shall be restricted to the replacement value of the Product.
f) Any services under the warranty shall neither bring about an extension to the warranty period, nor shall they substantiate a new guarantee.
g) All damage caused by improper handling, for example due to non-compliance with the usage instructions.

8.
Liability
8.1) Notwithstanding anything herein contained, the Manufacturer or SFBS and Lifestyle Medico Limited shall not be liable to the user or any third party whatsoever for any damage, loss, liability or failure to provide maintenance services under this warranty in respect of any act, omission or negligence of any technician, employee or independent contractor of the Manufacturer or SFBS and Lifestyle Medico Limited relating to the performance or purported performance of any obligations under this warranty.
8.2) You shall bear the risk and be responsible for all damage, injury or loss (including consequential loss, loss of profit, injury or damage) arising directly or indirectly out of or in connection with the service, delivery, or use of the Product.
8.3) The maximum liability of the Manufacturer or SFBS and Lifestyle Medico Limited under this warranty shall be restricted to the replacement value of the Product.
9. This warranty shall not extend to anyone other than the original purchaser of the Product. The Manufacturer or SFBS and Lifestyle Medico Limited shall be entitled to transfer or assign all its rights and obligations under the warranty to any company in Hong Kong which is associated with the Manufacturer or SFBS and Lifestyle Medico Limited. 
10. Unless the warranty services for the Product include on-site repair under Clause 5, the warranty services under this warranty will only be performed if the Product is picked up / delivered to our designated service centres.
11. SFBS shall not be responsible or liable for any insurance coverage in relation to the Product.
12. The Manufacturer, SFBS and Lifestyle Medico Limited reserve the right to amend or cancel any of the above terms and conditions of Warranty without prior notice.
13. The Manufacturer, SFBS and Lifestyle Medico Limited reserve the right to terminate the warranty in the event of any uncertainty or doubt as to the applicability of these terms and conditions.
14. In case of any dispute, SFBS reserves the right to make the final decision.
15. This warranty shall be construed and governed by the laws of Hong Kong.
   
Notes:
1 According to the date of purchase as stated in the original invoice or receipt issued by the authorized dealers. The end date of the Warranty Period is also calculated from this date of purchase.
Warranty Policy outside of Hong Kong SAR
All products sold by shopforbettersleep.com do not have international warranty. If you are an international customer, or a Hong Kong customer travelling outside of Hong Kong, you will have to contact shopforbettersleep.com for warranty services. Please do not contact the manufacturers or your local dealers. You will need to send the defective products to shopforbettersleep.com, and we will send the replaced or repaired products to you.  
It is your responsibility to cover the round trip shipping; shopforbettersleep.com will NOT cover the shipping cost to and from Hong Kong to your address.
 
Appendix to the Warranty Personal Data Privacy Policy
SFBS will treat any personal data submitted to this site in accordance with the Personal Data (Privacy) Ordinance (Cap. 486, laws of Hong Kong) and our privacy policy in force from time to time.
